Terms of Service

1. Acceptance of Terms

Welcome to Wreadom. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement under the Indian Contract Act, 1872, between you and Wreadom. The Service is governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of courts in Rajasthan, India only.

2. Definitions

  • "Service" refers to the Wreadom web application, mobile application, and all associated features
  • "User," "you," "your" refers to the individual accessing or using the Service
  • "Content" refers to text, images, audio reviews, comments, replies, reviews, messages, drafts, chapters, and other materials
  • "Original Works" refers to stories, poems, articles created by users
  • "We," "us," "our" refers to Wreadom and its operators

3. Eligibility

To use our Service, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using the Service under Indian law
  • Provide accurate and complete registration information

If you are between 13 and 18 years of age, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

4. User Accounts

4.1 Account Creation

You must create an account to access certain features. You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we deem inappropriate or harmful to the Service or other users.

5. Intellectual Property Rights

5.1 Your Content

You retain all ownership rights to the Original Works and other content you create and publish on Wreadom. By publishing content, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Display, distribute, and promote your content on our Service
  • Make your published works available to other users
  • Create derivative works for the purpose of formatting and displaying content

You represent and warrant that you own or have the necessary rights to all content you publish and that your content does not infringe upon the intellectual property rights of any third party.

Drafts, unpublished chapters, and chapter version history remain under your ownership and are provided as authoring tools. You are responsible for reviewing content before publishing, moving chapters to drafts, importing drafts into a book, restoring previous versions, or inviting collaborators who may edit your work.

5.2 Our Content

The Service itself, including its design, functionality, text, graphics, logos, and software, is owned by Wreadom and protected under the Copyright Act, 1957, and other applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Service without our written permission.

5.3 Third-Party Content

We provide access to public domain books from Internet Archive and other sources. We do not claim ownership of these works and they remain subject to their respective copyright status.

6. User Conduct and Prohibited Activities

You agree NOT to:

  • Publish content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Infringe upon the intellectual property rights of others
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, bully, or harm other users
  • Misuse messages, chats, replies, audio reviews, or collaboration tools to spam, harass, impersonate, or pressure others
  • Distribute spam, viruses, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers) without our permission
  • Violate any applicable laws or regulations of India
  • Engage in any activity that disrupts or interferes with the Service

7. Content Moderation

We reserve the right, but are not obligated, to:

  • Monitor and review user-generated content
  • Remove or modify content that violates these Terms
  • Take action against users who violate these Terms

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we will make reasonable efforts to remove unlawful content upon receiving actual knowledge or notification.

Content moderation may apply to published works, feed posts, comments, replies, reviews, audio reviews, messages reported to us, and collaboration activity that affects other users.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with the Digital Personal Data Protection Act, 2023, and the Information Technology Act, 2000. By using the Service, you consent to our data practices as described in the Privacy Policy.

Some features, including text-to-speech controls, media notifications, audio reviews, replies, direct chats, group chats, and collaboration requests, may process additional content or device-level notification preferences needed to provide those features.

9. Copyright Infringement

We respect intellectual property rights and expect our users to do the same. If you believe your copyright has been infringed, please contact us with:

  • Identification of the copyrighted work
  • Identification of the infringing material
  • Your contact information
  • A statement of good faith belief that the use is unauthorized
  • A statement of accuracy under penalty of perjury

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of content

11. Limitation of Liability

To the fullest extent permitted by law, Wreadom shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to:

  • Loss of data or content
  • Loss of profits or revenue
  • Personal injury or property damage
  • Third-party claims

Our total liability shall not exceed ₹1,000 (One Thousand Rupees) or the amount you paid us in the last 12 months, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wreadom, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you publish on the Service

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Rajasthan, India.

13.3 Arbitration

Before filing any lawsuit, you agree to attempt to resolve disputes through good faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Extended period of inactivity
  • Request by law enforcement or government authority

Upon termination, your right to use the Service will cease immediately. We may, but are not obligated to, delete your account and content.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Wreadom regarding the use of the Service and supersede all prior agreements and understandings.
